PRIVACY POLICY
You must read this Privacy Policy, and related documents (the Terms of Use and the Acceptable Use Guidelines), carefully before accessing or using any of the Andi’s Way (AW) Web Sites (as hereinafter defined). By accessing or using the AW Web Sites, you agree to be bound by this Privacy Policy and the Terms of Use and the Acceptable Use Guidelines and all the terms and conditions set forth herein and therein. If you wish not to be bound by these terms you must navigate away from any of the AW Web Sites now, and you are prohibited from accessing and using such Web sites until such time as you are willing to be so bound. If you use the AW Web Sites in a manner inconsistent with this Privacy Policy, the Terms of Use or the Acceptable Use Guidelines AW may terminate your access, block your future access and/or seek such other additional relief as AW, in its sole and reasonable discretion, shall determine. This Privacy Policy may be modified per its terms.
1. Information About Visitors to the AW Web Sites
AW keeps track of the Web sites and pages our visitors view within the AW Web Sites to enable AW
to determine what sites and services are the most popular. This data can be used to deliver customized content and advertising to AW’s customers and other visitors to the AW Web Sites whose behavior indicates that they are interested in a specific subject area. AW’s service may automatically gather certain usage information like the numbers and frequency of visitors to the AW Web Sites and its pages, and AW will only use information gathered in this manner in the aggregate to enable AW to improve and better design the AW Web Sites.
To facilitate the above, AW Web sites may use a technology called “cookies” – small files attached to your Web browser – which tell AW how and when pages in the AW Web Sites are visited, and by how many people. AW’s cookies do not collect personally identifiable information and do not combine information collected through cookies with other personally identifiable information, so users remain anonymous. AW may also provide statistical “ratings” information in the aggregate (and never about individual users personally) to AW’s partners about how visitors, collectively, use the AW Web sites.
2. Use of Cookies
Some AW Web Sites may use “cookies” to personalize users’ online experience. Cookies cannot be used to run programs or deliver viruses to users’ computers. Cookies are uniquely assigned to individual users, and can only be read by a Web server in the domain that issued such cookies.
Among the primary purposes of cookies is to indicate to AW’s Web server that a particular user has returned to a specific page and enables AW's Web servers to “remember” such users from prior visits – including any preferences such users may have established during such prior visits. This simplifies the process of recording personal information, such as billing addresses, shipping addresses, etc. When a visitor returns to the same AW Web site, the information previously provided can be retrieved, so that such visitor can easily use the AW Web Sites’ features previously customized.
Users have the ability and the right to accept or decline cookies. Most Web browsers automatically accept cookies, but users may be able to modify their browser settings to decline cookies or purchase third-party programs that provide such functionality. If a user chooses to decline cookies, such user may not be able to fully experience the interactive features of the AW Web Sites visited.
3. Use of Third Party Advertising
AW sometimes enter contracts to provide space on the AW Web Sites to third-party advertisers. AW will never reveal users’ personal data or data about a user’s specific visits to the AW Web Sites to such third-party advertisers. AW reserves the right to provide information to such third-party advertisers about visitors to the AW Web Sites in the aggregate, absent any personally-identifying information.
4. Information About You
AW may request specific information about a user when such user signs up to use a service or orders a product through the AW Web Sites. AW does not sell, rent or lease its customer lists to third parties. AW does, however, require specific information to enable provisioning of such service or product, to bill for the same, and to enable AW to properly credit and maintain users’ accounts. Such information typically includes, but may not be limited to, name, Internet address or screen name, billing address, type of computer, phone number and perhaps a credit card number. AW reserves the right to use such information to inform users of additional products and services which AW believes they might be interested in learning about. In the event AW exercises this right, users can opt not to receive such information by letting AW know on the registration screen when signing up for the product or service. AW may ask users to identify their interests to enable AW to enrich users’ online experience; users may choose to respond or not. Additionally, AW may offer users an opportunity to be listed in a directory on one of the AW-branded services; such listings are also optional and users can edit or delete their listing information at their discretion.
AW takes all reasonable precautions to prevent correlation of any user-sensitive data, such as race, age, religion, political affiliation, or sexual orientation, with personally identifiable data.
5. Security of Users’ Personal Information
AW secures users’ personal information from unauthorized access, use or disclosure, and secures their personally identifiable information we receive from them on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. Personal information is transmitted to other Web sites through the use of Secure Socket Layer (SSL) encrypted protection.
6. Third Party Disclosure
AW does not use or disclose information about users’ individual visits to AW Web Sites or personal data that they may provide AW, such as name, address, email address or telephone number, to any un-affiliated companies. AW may share with our AW Web Site partners aggregated ratings information about access to and use of AW Web Sites, however, and AW may utilize the services of trusted partners to assist in such statistical analysis. All such third parties are prohibited from using users’ personal information except to provide such services to AW, and are required to maintain the confidentiality of users’ information.
AW never discloses personal information without notice to the owner of such information unless required to do so (i) by law or in the good faith belief that such action is necessary to comply with the law and legal process, (ii) in the good faith belief that such action is necessary to protect the safety of an AW Web Sites user or other AW customer or the public generally, or (iii) in the good faith belief that such action is necessary to protect and defend the rights of AW, its affiliates and subsidiaries.
7.Children & The Web
AW does not specifically collect information about minors and believes that minors should get their parents’ consent before giving out any personal or sensitive information whether over the Internet or otherwise. AW encourages parents to be engaged and proactive participants in their minor’s experience in cyberspace and otherwise, and to review important safety tips before their minor explores the Internet; AW also encourages minors to consult with their parents before giving out information of any kind about themselves and their families whether on the Internet or otherwise. AW supports and encourages the use of Web filtering technology to supervise and protect young minors’ access to online information.
8. Privacy Policy Changes
AW reserves the right to update and change this Privacy Policy in light of both industry best-practices, user comments and its own discretion. Notice of changes to the Privacy Policy will be provided on the AW Web Sites’ homepage (www.andisway.com). In the event AW believes, in its sole discretion, that such changes materially change these policies, AW will provide notice of such proposed changes prior to their being implemented; such notice shall appear on the AW Web Sites’ homepage. Users are responsible for periodically reviewing these policies to ensure their continued comfort as to AW's handling of their confidential and identifying information.
9. Enforcement

10. Rules of User Conduct
User, by posting information in or otherwise using any AW-provided service that may be available to user on or through the AW Web Sites, agrees not to upload, post, or otherwise distribute or facilitate distribution of any content including, without limitation, text, software code (whether object, executable or otherwise), images, sounds, or other data or information that:
a. is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortuous, contains explicit or graphic descriptions or accounts of sexual acts of a violent or threatening nature directed at another individual or group of individuals, or otherwise violates AW’s rules or policies;
b. Victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, disability or any other protected status;
c. Infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any other entity;
d. Constitutes unauthorized or unsolicited advertising, junk or bulk e-mail (also known as “spamming”), chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling;
e. Contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party; or
f. Fraudulently impersonates any person or entity, including any employee or representative of AW.
User further agrees to refrain from “data mining” or otherwise gathering or collecting (whether through solicitation or otherwise) data or information about or regarding any other user of the AW Web Sites whether to facilitate the transmission of unsolicited bulk electronic e-mail or otherwise.
AW does not in any way monitor or edit content posted by users of the AW Web Sites. AW does, however, reserve the right, whether itself or via its agents, to do so, and if in AW’s sole discretion it determines the need, to remove or otherwise edit any content that (i) does not comply with the this Privacy Policy, AW’s Terms of Use for the AW Web Sites or AW's Acceptable Use Guidelines for the AW Web Sites or (ii) is otherwise harmful, objectionable, or inaccurate. Notwithstanding the foregoing, AW is not responsible for any failure or delay in removing or editing such content.
11. Copyrighted Materials
The AW Web Sites contain various types of content including graphics, text, sounds, animated material, design and layout elements, and other copyrighted and similarly protected content owned or licensed by AW or its third-party suppliers. Users are not permitted to use this information in any manner or for any purpose other than as expressly authorized herein and in the AW Web Sites. The policies below relate solely to that content owned by AW. For information, and permission to use, the content of third-party content rights owners, Users are directed to contact such third-party content rights owners directly.
a. Permission Granted to Users of the AW Web Sites
Acceptance of this Privacy Policy, AW’s Terms of Use and Acceptable Use Guidelines conveys to accepting users permission to view, copy, download, and print, for personal use only, any copyrighted materials (but not trade or service marks or logos, whether registered or otherwise) owned by AW and available on the AW Web Sites, subject to the following conditions:
(i). Such materials may only be used for personal, noncommercial, and informational purposes. Under no circumstances may they be posted, distributed or modified;
(ii). All copyright and other proprietary notices must be retained in such materials; and
(iii). Users may not reproduce, copy, or redistribute the design or layout of the AW Web Sites, individual elements of such design or layout, nor any trade or service marks or logos without AW’s prior express written permission.
b. Permission for Commercial Use
Reproduction, copying, or redistribution for any commercial purpose whatsoever of any materials or design elements on the AW Web Sites is strictly prohibited without AW’s prior express written permission. AW reserves the right to grant such permission at its sole discretion upon written request for such permission reasonably detailing (i) what materials or design elements are at issue and their URL addresses, (ii) the nature of the use for which permission is sought, and (iii) the identity and nature of the entity requesting such permission. In addition, all such requests for permission must contain a statement to the effect that, if the permission sought is granted, the requesting entity shall defend and hold harmless AW from any and all claims, liabilities, expenses and costs, including reasonable attorneys fees, that are connected in any way whatsoever with the requesting entity’s use of the materials or design elements for which such permission is granted, and failure to include a statement to such effect shall conclusively disqualify any such request from consideration for the permission sought.

c. Procedure for Making Claims of Copyright Infringement
AW, its affiliates and subsidiaries respect and heed the intellectual property rights of others, and require its third-party content suppliers and other vendors to do the same. If, despite AW’s best efforts, a user believes any content on the AW Web Sites to be illegally infringing such user’s intellectual property rights, such user is requested to contact AW in writing at the mailing address above, attention: Legal Department. Any such notice shall be in writing and shall include (i) a reasonably detailed explanation of what materials or design elements are at issue, their allegedly infringing use, and their URL addresses within the AW Web Sites, (ii) the location (physical or electronic, and if electronic and network-accessible, the URL) of each alleged protected original of such material or design, (iii) a statement to the effect that there is a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law, (iv) a statement by the author of such notice, made under penalty of perjury, that the above information in such notice is accurate and that such author is the copyright owner or authorized to act on the copyright owner’s behalf, and (v) the electronic or physical signature of the author of such notice, including such author’s name, address, telephone number, and email address.
